Jalandhar, June 7, 2013: The Central Bureau of Investigation has filed a chargesheet against 13 accused persons in the court of Special Judicial magistrate, CBI cases, Lucknow (Uttar Pradesh) in a case relating to the alleged murder of Ziaul Haque, then DSP and Circle Officer of Kunda, Pratapgarh (Uttar Pradesh). Twelve persons all residents of Balipur, District Pratapgarh (Uttar Pradesh) have been chargesheeted U/s 147, 148, 302, 323, 332, 353, 201, 506 IPC r/w 149 IPC and Section 27 of Arms Act for their alleged role in the assault and murder of DSP Ziaul Haque, the then Circle Officer, Kunda, District Pratapgarh and assault on the police party led by him. One more person has been charge seethed U/s 201 IPC for destroying evidene.
This was stated by the spokesperson of the CBI today. He said the investigation revealed that the then CO, Kunda had gone to the house of Nanhe Yadav, then Pradhan of Balipur District Pratapgarh in order to deal with law and order situation arising out of the murder of Nanhe Yadav. The family members and supporters of Nanhe Yadav led by his brother Suresh Yadav (since dead) allegedly assaulted the then CO and the other three police officials accompanying him. The then CO was caught and brutally assaulted by the accused persons but the three other police officials managed to escape. During the scuffle, Suresh Yadav sustained gunshot injuries from his own DBBL gun with which he was hitting the then CO, Kunda while the accused persons named in chargesheet assaulted and allegedly killed Ziaul Haque, the then CO, Kunda.
He said that further investigation into other aspects including the role of other suspects/ FIR named accused is in progress u/s 173 (8) Cr.P.C.
CBI had also registered four cases relating to murder of three persons, including Ziaul Haque, then Deputy Superintendent of Police of Uttar Pradesh and two other persons, namely Nanhe Yadav and his brother Suresh Yadav, both of District Pratapgarh (UP) in separate incidents on March 2, 2013 on the request of UP Govt. and after Notification by Govt. of India. CBI has taken of the investigation of these cases which were earlier registered by Uttar Pradesh Police.
He said that the investigation into alleged murder of Suresh Yadav, brother of Nanhe Yadav has also been completed. A closure report has been filed as it emerged during investigation that Suresh Yadav had died after sustaining fire arm injuries from his own DBBL gun
The spokesperson said that twelve alleged accused persons (i) PhulchandYadav, (ii) PawanYadav, (iii) YogenderYadav @ Bablu, (iv) RaghuvenderYadav @ Dablu, (v) ManjeetYadav, (vi) GhanshayamYadav, (vii) Ram LakhanGautam, (viii) ChhoteLalYadav, (ix) Ram Ashre @ Panne, (x) MunnaLal Patel, (xi) Shiv Ram Passi and (xii) JagatBahadur Pal @ Bulle Pal, all R/o Balipur, District Pratapgarh were chargesheeted.
He said,One more accused charge sheeted Sudhir Yadav U/s 201 IPC for destroying evidence.
The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it. Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial, the release said.
