Two accused convicted in a case relating to death of Md.Afzal Khan

New Delhi, December 24, 2014: The Special Judge, CBI cases, Dehradun (Uttranchal) has today convicted two private persons, namely Rakkam Singh and Varinder Singh U/s 148, 149 and 302 of IPC in a case relating to death of Md.Afzal Khan.

A case was registered by CBI against Rakkam Singh and Varinder Singh U/s 147, 148, 149 and 302 IPC r/w 109 of IPC on 17.12.1989 on the request of Uttar Pradesh Government and further Notification from Government of India dated 16.12.1989.

CBI took up the investigation of the case which was initially registered at Police Station Kotwali, Roorkee on 24.11.1989 U/s 147, 148, 149 & 302 IPC against Rakkam Singh and Varinder Singh on the complaint of a candidate from a political party contesting election from Roorkee Assembly constituency. It was alleged that when he along with others were returning from village Belari in Maruti Gypsy driven by Md Afzal Khan, a white ambassador car blocked their way near Roorkee - Hardawar Highway and Varinder Singh Saini on being prompted by accused Rakkam Singh fired from the DBBL gun which hit Md.Afzal Khan who later succumbed to his injuries.

After concluding the investigation, a charge sheet was filed in the court of Special Judge, Dehradun on 14.06.1990.

During trial, 28 witnesses were examined in support of prosecution and at the conclusion of trial, both the accused persons have been found guilty of the murder and convicted for the offences u/s 148, 149 and 302 IPC. Both the accused persons have been taken into judicial custody and sent to jail.

The sentence will be pronounced on 02.01.2015.
