New Delhi, June 4 (IANS) A court here has directed Delhi Police to register first information report (FIR) and probe allegations of cheating, forgery and criminal conspiracy against some AAP members for purportedly filing a forged document with the Election Commission.
Metropolitan Magistrate Akash Jain passed the order while hearing a petition filed by a political party's founding member seeking registration of an FIR against some Aam Aadmi Party members, who were earlier with his party, alleging that they had sent a forged resolution of his party which was purportedly signed by them.
The court said: "Keeping in view the facts, circumstances of the case and documents adduced on record, this court is satisfied that prima facie cognizable offences are disclosed...and the investigation by police is required to unearth the true facts and to ascertain the allegations of cheating, forgery and criminal conspiracy allegedly committed against the complainant."
"The present application under section 156 (3) CrPC (Criminal Procedure Code) of the applicant is accordingly allowed. SHO (station house officer) PS Parliament Street is directed to register FIR in the present case under appropriate sections of law and proceed with investigation," the court said in its order delivered Tuesday.
The court has fixed the matter for further hearing Aug 20.
The complainant alleged that these accused had forged the documents in pursuance of criminal conspiracy. He said the accused joined AAP on the day of its formation without giving resignation from his party by by giving an affidavit to Election Commission that they were not a member of any political party at the time of joining AAP, which was completely false.
