New Delhi, March 26, 2014: The Special Judge, CBI cases, Ernakulam (Kerala) has convicted six accused persons namely Nigil; Biju; Riyaz; Vineesh Vazhakkadan; P. Sumesh and P.P Basheer in a case relating to the murder of  Sainudheen (a Worker of a Political organisation) and sentenced them to undergo Life Imprisonment with fine of Rs. 50,000 each.
CBI had registered the case on 27.09.2008 and taken up the investigation of Crime No. 373 of 2008 of Iritty Police Station (Kerala) on the directions of Kerala High Court.
It was alleged that the place Kakkayangad situated in the southern part of Kannur District (Kerala) had strong influence of a leading political party. A new political organisation was started in 2003 for the uplift of a particular community and was growing very rapidly in the district of Kannur which clashed with the interest of other existing political parties over the control of that community. The deceased Sainudheen was allegedly seen as influencing and drawing members of that particular community to the recently launched political organisation. This led to rivalry between the existing political party and the new political organization, which allegedly led to the murder of  Sainudheen.
It was further alleged that the nine accused who were the workers of Leading Political Party of State entered into a criminal conspiracy to kill Sainudheen, (a worker of New Political Organisation). In pursuance of the said criminal conspiracy, Sainudheen was attacked by five accused with deadly weapons on 23.06.08. The injured Sainudheen, who was taken to hospital, succumbed to injuries on the same day. The mother of deceased Sainuddeen, filed a WP(C)No.20767/2008(P) before the  High Court of Kerala praying for CBI investigation.  The High Court of Kerala ordered for CBI Investigation on 03.09.2008.
After thorough investigation, CBI filed a charge sheet before the Chief Judicial Magistrate, Ernakulm on 20.11.2009 against the 11 accused persons U/s 120-B, 143, 147, 148,341,302 r/w 149 and substantive offences.
The Trial Court found six accused guilty and acquitted five persons.
