Life imprisonment to then inspector and then constable of Haryana Police in Jitender Pahal encounter case

New Delhi, March 21, 2014: The District & Sessions Judge Ambala has convicted the then  Inspector Nar Singh and then Constable Ramesh Chander, both of Haryana Police U/s 302, 201, 218, 193, 34 of IPC for their involvement in the Jitender Pahal encounter case and sentenced them to undergo Life Imprisonment with fine of Rs.10,000 each.

The case was registered on January 17, 1996 in CBI on the Orders of Punjab & Haryana High Court dated November 27, 1995 in Civil Writ Petition No.3921/95 filed by the mother of deceased Jitender Pehal, resident of  District Jind(Haryana) regarding death of his son (Jitender Pahal) and one Randir Singh on October 25, 1994 while in police custody. She had requested the Hon’ble High Court for ordering the CBI enquiry in the matter of elimination of her son   Jitender Pahal and one Randhir Singh  under mysterious circumstances on October 25, 1994 while in police custody near Village Ishapur Kheri expressing suspicion of hands of Haryana Police officials in such elimination. 

CBI Investigation disclosed that the deceased Jitender Pahal and Randhir Singh were known criminals in Haryana.  Deceased Jitender Pahal was lodged in Ambala jail from June 1991 to December 1991 and in Bhiwani Jail from September 1992 to September 25, 1993.  In 1991, one private person of Panchkula, who was friendly with son of Additional DG(Prisons), Haryana allegedly clashed with Jitender Pahal. The son of Additional DG(Prisons) had allegedly visited Ambala Jail & had heated arguments with Jitender Pahal. The CBI investigation further disclosed that during the period from August 24, 1994 to April 30, 1995, the said Addl.DG (Prisons) posted as DGP Haryana had entered into a criminal conspiracy with around five police officials and allegedly eliminated both Jitender Pahal and Randhir Singh.

On completion of the investigation, CBI filed chargesheet U/s 120-B r/w 302, 201 and 218 IPC on August 10, 1996 against then ADG(Prisons); then Inspector; then Constable and other three police officials. The accused were tried by the Court of District and Sessions Judge Ambala.   One accused died during trial.

The Court of District and Sessions Judge Ambala has held accused Nar Singh and Ramesh Chander guilty for commission of offence U/s 302/201/218/193/34 of IPC and, acquitted three other police officials including then Addl DG(Prisons/then DGP).
